1. About these terms

These Terms and Conditions ("Terms") apply to your use of the DWN N OUT Motorcycle Sales website (www.dwnnout.com), our online inventory (dwnnout.shop), and your dealings with DWN N OUT Motorcycle Sales ("DWN N OUT," "we," "us"), located at 15010 N Cave Creek Road, Phoenix, AZ 85032. By accessing or using our website, or by buying a vehicle from or doing business with DWN N OUT, you agree to be bound by these Terms. If you do not agree, please do not use the website or buy from us.

These Terms do not replace the purchase agreement, buyer's order, warranty contract or finance contract you sign when you buy a vehicle. If those documents conflict with these Terms, those documents control.

2. Website information

We work to keep our listings, prices, photos, mileage, specifications and availability accurate and current. Inventory changes quickly and errors can happen. Photos and descriptions are for general information and may not show every detail of a vehicle.

A listing is not an offer or a guarantee that a vehicle is still available. Please call 602.422.9333 to confirm availability, price and details before you travel. We may correct errors and change or remove listings at any time without notice.

3. Prices and fees

DWN N OUT charges $0 dealer fees. Prices shown on the website do not include sales tax, title, registration or other government fees, which are the buyer's responsibility.

4. Pre-owned vehicles

Our pre-owned motorcycles, used scooters and other vehicles are used. Condition, wear and history vary from vehicle to vehicle. Title status is shown in the listing where available. We encourage you to see the vehicle in person and to ask us any questions before you buy. We do not offer test rides.

5. Free 1-year warranty

Most pre-owned bikes sold by DWN N OUT include a free 1-year warranty with a deductible. The warranty is fulfilled by one of the two third-party warranty companies DWN N OUT works with, not by DWN N OUT. Each warranty follows that company's guidelines, and the coverage, deductible and terms are discussed with you at the time of purchase. The warranty is intended to help cover major mechanical failure that happens unexpectedly and may not cover every minor incident. Coverage, exclusions, the deductible amount and the claims process are set out in the warranty contract for your vehicle, which controls.

Not every vehicle includes the warranty. Some bikes are sold as-is, without a warranty. Please ask us which bikes include the warranty before you buy.

DWN N OUT is not responsible for the services, coverage or benefits offered by the third-party warranty companies, or for their decisions on claims. The buyer is responsible for following the rules and requirements in the warranty company's contract and for working directly with the warranty company.

6. New scooters

We are the Valley's exclusive Genuine Scooter Co. dealer, and the only new scooters we sell are Genuine scooters. We also sell used scooters, which are covered by the pre-owned vehicle terms above. Prices and models on the website may change. Warranty coverage on a scooter depends on the scooter. Please ask us about the coverage on the exact model before you buy.

7. Financing and credit applications

We work with several finance companies and welcome buyers with all credit situations. Submitting a credit application does not guarantee approval or any particular rate, payment or term. Approval, rates and terms are decided by the finance company and are subject to its requirements.

Our digital credit application is provided through a third-party service (JotForm). Information you submit is used to evaluate your application and may be shared with finance companies. Please do not send sensitive information such as Social Security numbers by email or text.

8. Service

DWN N OUT services street, dirt and off-road vehicles. Service pricing depends on the work needed. Please call 602.422.9333 for service information. Estimates are not a guarantee of final cost.

9. Customer reviews

Reviews shown on our website are provided by customers through Google and are displayed using a third-party widget. Reviews reflect the opinions of the reviewers, not DWN N OUT.

10. Third-party websites and services

Our website links to and uses third-party services, including our online inventory (dwnnout.shop), JotForm, Google and social media sites. We do not control these services and are not responsible for their content, availability or privacy practices. Your use of them is governed by their own terms.

11. Intellectual property

The DWN N OUT name, logos, text, graphics and website design are owned by DWN N OUT or used with permission. Photos of vehicles are provided for shopping purposes. You may not copy, reproduce or use our content for commercial purposes without our written permission.

12. Disclaimer and limitation of liability

The website is provided "as is" and "as available." To the fullest extent allowed by law, DWN N OUT does not guarantee that the website will be uninterrupted or error-free, and is not liable for losses arising from your use of the website. Nothing in these Terms limits any rights you have under the law that cannot be limited.

13. Governing law

These Terms are governed by the laws of the State of Arizona.

14. Changes to these Terms

We may update these Terms from time to time. The updated Terms apply when posted on the website. Last updated: October 11, 2026.
